The agreement

These terms are an agreement between you and Nexoma Labs LLC, which publishes Hundy. By downloading or using Hundy you accept them; if you do not, please do not use the app. The privacy policy explains how your data is handled and forms part of these terms.

What Hundy is

Hundy is a fitness tracking app that counts push-up repetitions using your device camera. It is provided for general fitness and training purposes.

Who can use Hundy

Hundy is designed for adults. If you are under 18, or under the age of majority where you live, use it only with the permission and supervision of a parent or guardian.

Hundy is not medical advice

Rep counts, quality scores and form cues are training aids, not clinical assessments. Hundy is not a medical device. It cannot diagnose an injury, judge whether an exercise is safe for you, or replace a qualified coach or clinician. Consult a professional before starting a new training programme, especially if you are pregnant, injured or have a medical condition, and stop if you feel pain, dizziness or shortness of breath.

Train safely

You are responsible for your own safety and for your surroundings. Clear enough space around you, place your phone where it cannot be stepped on or knocked over, and do not train to the point where your form collapses. Never place a device where a fall could injure you.

Accuracy

Hundy verifies repetitions from what the camera can see. Lighting, camera angle, clothing and body position all affect what it can detect, and it will sometimes miss a rep or count one you would have judged differently.

Your licence

We give you a personal, non-exclusive, non-transferable and revocable licence to use Hundy on devices you own or control, in line with the usage rules of the store you got it from. You may not copy, modify, resell or redistribute the app, or reverse-engineer it except where the law allows you to. Hundy includes open-source software, which is licensed under its own terms. The app itself — its code, design and artwork — belongs to Nexoma Labs.

Your data

Your workouts are stored only on your device. You are responsible for your own backups; if you delete the app, lose the device or clear its data without a device backup, your history is gone and cannot be recovered by anyone.

Acceptable use

Do not use Hundy to record or analyse anyone who has not agreed to it. Do not attempt to falsify verified rep counts, particularly once competitive features exist — the entire value of a camera-verified number is that it is honest.

Warranty and liability

To the fullest extent the law allows, Hundy is provided "as is" and "as available", without warranties of any kind, including of accuracy, fitness for a particular purpose or uninterrupted operation, and we are not liable for indirect or consequential loss arising from your use of it.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, or for fraud — or affects your statutory rights as a consumer. If you live in the European Union or the United Kingdom, you keep the legal guarantee that digital content conforms to its description.

App Store and Google Play

These terms are between you and Nexoma Labs, not Apple or Google. We alone are responsible for Hundy and its content, for its maintenance and support, and for handling any claim relating to it — including product liability, failure to meet a legal or regulatory requirement, consumer protection or intellectual property claims. Apple and Google have no obligation to provide maintenance or support for Hundy.

If you downloaded Hundy from the App Store: if it fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the maximum extent the law allows, Apple has no other warranty obligation for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not located in a country subject to a US Government embargo or designated as "terrorist supporting", and that you are not on any US Government list of prohibited or restricted parties.

Your use of Hundy must also follow the terms of the store you downloaded it from, and any third-party terms that apply to your device.

Ending

You can stop using Hundy at any time by deleting it. We may change or stop offering the app, and your licence ends automatically if you break these terms. The sections on medical advice, warranty and liability continue to apply afterwards.

Governing law

These terms are governed by the laws of the place where Nexoma Labs LLC is established, without regard to its conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts there.

Changes

These terms may be updated as the app gains features. The date at the top changes with every revision, and material changes will be described in the app before they take effect.
